Return & Refund Policy

1. General Return Policy We have a 14-day return policy, which means you have 14 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

3. Shipping Costs & Refunds

• Return Shipping: You are responsible for paying the shipping costs for returning your item. These costs are non-refundable.

• Original Shipping Costs (EU Customers): If you are returning an order from within the European Union, we will refund the original shipping cost upon a full return.

• Original Shipping Costs (Non-EU / USA / UK / CH): For orders shipped outside the European Union, original shipping fees are not refundable. You will receive a refund for the item price only.

• Free Shipping Adjustment: If you return part of an order and the remaining value falls below our free shipping threshold (€100), we reserve the right to deduct the standard shipping fee from your refund.

4. Important Instructions for Non-EU Returns (USA, UK, CH, etc.) To avoid unnecessary customs duties and taxes, it is mandatory to declare your return correctly.

• Mark as "RETURNED GOODS": Clearly write "RETURNED GOODS" on the outside of the package and on the customs declaration form (CN22/CN23).

• Attach Original Invoice: Please attach a copy of your original invoice in a clear plastic pouch on the outside of the parcel.

• Notify us: We strongly recommend contacting us before shipping your return from outside the EU so we can provide you with the necessary guidance to ensure a smooth customs process.

• Note: If a return is not declared correctly and results in import duties or taxes for NGHTY Berlin, these costs will be deducted from your final refund amount.

5. Exceptions / Non-returnable items Certain types of items cannot be returned, for example:

• Custom products (such as special orders or personalized items).

• Sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., certain intimate apparel if the hygiene seal is broken).

• Gift cards.

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item.

 

Right of Withdrawal (Statutory Rights)

Right of withdrawal You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (NGHTY Berlin GmbH, Brunnenstr. 13, 10119 Berlin, Germany, Email: hello@nghtyberlin.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
